Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Scour website, iOS application, and related services (collectively, the "Platform"). By creating an account, accessing content, or using any feature of the Platform, you agree to be bound by these Terms and our accompanying Privacy Policy. If you do not agree, you must not use the Platform.
The Platform is operated by Scour Inc. ("Scour," "we," "us," or "our"). We may update these Terms from time to time. Material changes will be communicated through in-app notices, email, or other reasonable means.
2. Description of Services
Scour is designed to help student-athletes discover, organize, and communicate with college athletic programs. Current features include:
- Personalized athlete profile creation and management
- Swipe-based discovery, matching, and saved lists for college programs
- Calendar tools with reminders for recruiting milestones and events
- AI-assisted outreach emails and coach contact search tools
- Optional Google or Apple authentication and account linking
- In-app purchases and subscriptions that unlock swipe credits, premium insights, and messaging capabilities
- Push notifications, deep links, and sharing features that connect the Platform across devices
- Secure data storage, media hosting, and analytics powered by trusted infrastructure partners
We may add, remove, or modify features to improve the experience or respond to regulatory, technical, or business considerations. When feasible, we will provide advance notice.
3. Eligibility and Account Registration
You must be at least 13 years old to use the Platform. If you are under 18, a parent or legal guardian must review these Terms and provide verifiable consent. By registering, you confirm that you:
- Are a student-athlete or their authorized representative
- Provide accurate, current, and complete information
- Will promptly update information to maintain its accuracy
- Have not been previously suspended or removed from the Platform
- Will comply with NCAA, NAIA, NJCAA, and other applicable recruiting rules
You are responsible for safeguarding your credentials and for all activity that occurs through your account. Notify us immediately if you suspect unauthorized access.
4. Account Responsibilities and Security
- Maintain secure passwords and enable device protections
- Use only the authentication methods (email, Apple, Google) that belong to you
- Review any automated email drafts carefully before sending them to coaches
- Download attachments only from trusted sources and scan for malware
- Back up important information you store or generate through the Platform
Scour is not responsible for lost access resulting from your failure to maintain security controls or update contact details.
5. Subscriptions, Swipe Credits, and Payments
Scour offers free and paid tiers. Premium access may include expanded swipe balances, unlimited program saves, enhanced analytics, or communication tools. When you initiate a purchase through the Apple App Store, the transaction is processed by Apple and our subscription partner RevenueCat. By purchasing, you agree to the following:
- All fees are quoted in U.S. dollars unless stated otherwise
- Subscriptions renew automatically until canceled at least 24 hours before the renewal date
- Swipe credits are a limited, non-transferable license to use certain in-app features and have no cash value
- Refunds are handled according to Apple and RevenueCat policies; contact Apple Support for billing disputes
- Promotional pricing, trial periods, or credit grants may be modified or revoked at our discretion
We may adjust product offerings, pricing, or included features with reasonable notice. Continued use after changes become effective constitutes acceptance.
6. Communications and Email Tools
The Platform provides an email composer that can generate drafts using OpenAI models and send messages through the Gmail API when you sign in with Google. These tools are optional and require you to review and approve all content before delivery. By using them, you acknowledge that:
- AI-generated content may contain inaccuracies and must be verified by you prior to sending
- Scour may temporarily process message content to create or deliver emails, but you remain the sender of record
- You are responsible for complying with anti-spam laws and institutional communication policies
- Attachments you upload are transmitted via secure channels but should not contain sensitive personal data unless necessary
We may offer alternative delivery options in the future. Any new integrations will be described in updated Terms or product notices.
7. Acceptable Use
You agree not to engage in any of the following:
- Misrepresenting your identity, academic record, athletic performance, or eligibility
- Uploading unlawful, defamatory, or infringing content
- Extracting data via automated scripts, bots, or scraping tools
- Circumventing access limits, attempting to compromise security, or reverse engineering the Platform
- Sending spam, abusive messages, or unauthorized commercial solicitations to coaches or other users
- Sharing your account, selling swipe credits, or allowing others to impersonate you
- Uploading malicious code, viruses, or content that could damage systems
- Using AI or communication tools to violate NCAA rules or the privacy of others
We may monitor usage patterns and review reported content to enforce these Terms, consistent with our Privacy Policy.
8. Content Ownership and License
You retain ownership of content you upload, including profile data, highlights, notes, calendar entries, and email drafts. You grant Scour a worldwide, royalty-free, non-exclusive license to host, display, transmit, and adapt your content as necessary to operate the Platform. This license ends when content is deleted from our systems, subject to residual copies maintained for legal or backup purposes.
Scour and its licensors own all Platform software, designs, and intellectual property, including the swipe interface, filters, recommendation logic, and AI prompt engineering. You receive a limited, revocable license to use these elements for personal, non-commercial recruiting purposes.
We may anonymize and aggregate data to improve services, conduct research, or develop analytics. Aggregated insights do not identify individual users.
9. Third-Party Services and Integrations
Scour relies on trusted partners to deliver core functionality. By using the Platform, you consent to the processing described in their policies:
- Supabase for secure authentication, data storage, and media hosting
- RevenueCat and Apple App Store for subscription management and billing
- Sign in with Apple and Google Sign-In for account authentication
- Gmail API for sending athlete-authorized communications
- OpenAI for generating optional email drafts and summaries
- Apple Push Notification service and local notifications for reminders
- Analytics, crash reporting, or support tooling necessary to maintain the Platform
Third-party services may collect limited data as described in our Privacy Policy. We are not responsible for the acts or omissions of third parties, but we select partners that align with our privacy and security standards.
10. Privacy and Data Security
We implement administrative, technical, and physical safeguards to protect your information, including encrypted connections, access controls, and regular reviews of our infrastructure. Our detailed practices are described in the Privacy Policy. By using the Platform, you consent to the collection and processing outlined there.
If we learn of a data breach affecting your personal information, we will notify you in accordance with applicable law.
11. Calendar, Reminders, and Notifications
You can create calendar events linked to programs, add private notes, and enable reminders via push notifications. By opting in, you authorize Scour to schedule local notifications on your device and deliver updates related to your recruiting activity. You may adjust notification settings in the app or system preferences at any time.
Event data is synced to your account so you can access it from multiple devices. Deleting an event removes associated reminders, though copies may remain in backups for a limited period.
12. NCAA Compliance and Recruiting Rules
You are solely responsible for understanding and complying with NCAA, NAIA, NJCAA, state, and school-specific regulations. Scour does not guarantee compliance and does not provide legal advice. We may remove content or suspend accounts suspected of violating recruiting rules, and we will cooperate with lawful investigations.
Consult with coaches, compliance officers, or legal counsel if you have questions about your obligations.
13. Disclaimers and Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee scholarship offers, recruitment outcomes, uninterrupted service, or the accuracy of third-party data.
Scour will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or other intangible losses. Our aggregate liability arising from or relating to the Platform will not exceed the amounts you paid to Scour in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Scour, its officers, directors, employees, contractors, and partners from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Platform, violation of these Terms, or infringement of any third-party rights.
15. Termination and Suspension
You may delete your account at any time through in-app settings or by emailing support. We may suspend or terminate access immediately if we believe you violated these Terms, threatened Platform integrity, engaged in fraudulent activity, or if required by law. Upon termination, your license to use the Platform ends, and we may delete or anonymize your data consistent with our retention practices.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which Scour Inc. is organized and the applicable federal laws of the United States, without regard to conflict-of-law principles. Any dispute arising from or relating to the Platform will be resolved through binding arbitration administered by a nationally recognized arbitration provider, unless you opt out in writing within 30 days of accepting these Terms. Each party waives the right to a jury trial or to participate in a class action.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.
17. Changes to These Terms
We may revise these Terms to reflect product updates, legal requirements, or business needs. When we make material changes, we will provide notice and indicate the effective date. Your continued use after the effective date constitutes acceptance.
